Terms and Conditions – Wamda Application

Please read these Terms and Conditions carefully before using the Wamda application. By accessing, creating an account, or using any of the services provided through the application, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions, as well as the Privacy Policy and any other applicable policies published within the application.

1. Definitions

For the purposes of these Terms and Conditions, the following definitions shall apply:

  • Application: The Wamda application, including all related services, websites, systems, and digital platforms.

  • User: Any individual who creates an account or uses the application in any manner.

  • Merchant: Any restaurant, store, or service provider offering products or services through the application.

  • Delivery Partner: Any individual or entity responsible for delivering orders to users.

  • Order: Any purchase, reservation, or service request placed through the application.

2. Nature of the Service

Wamda provides an electronic platform that connects users with restaurants, stores, service providers, and delivery partners, enabling users to browse products, place orders, make payments, and track their orders.

Unless otherwise expressly stated, Wamda acts solely as a technology platform facilitating transactions between users and merchants and does not own, manufacture, or directly supply the products offered through the application.

3. Eligibility

By using the application, the user represents and warrants that they:

  • Have the legal capacity to enter into binding agreements.

  • Provide accurate, complete, and up-to-date information.

  • Will promptly update any information that becomes inaccurate.

  • Will use the application only for lawful purposes.

Wamda reserves the right to suspend or terminate any account containing false information or used in violation of these Terms.

4. User Account

The user is solely responsible for:

  • Maintaining the confidentiality of their login credentials.

  • All activities conducted through their account.

  • Immediately notifying Wamda of any unauthorized access or suspected security breach.

Wamda shall not be liable for any loss or damage resulting from the user's failure to protect their account credentials.

5. Orders

By confirming an order, the user confirms that all submitted information, including the delivery address, contact number, and order instructions, is accurate.

Wamda or the merchant reserves the right to reject, modify, or cancel any order in the following circumstances:

  • Product unavailability.

  • Pricing or technical errors.

  • Inability to deliver to the specified address.

  • Suspected fraudulent or abusive activity.

  • Operational or technical issues beyond reasonable control.

If an electronically paid order is cancelled, any eligible refund will be processed in accordance with Wamda's Refund Policy.

6. Prices and Promotions

  • All prices displayed in the application are subject to change without prior notice.

  • Prices and promotional offers may vary between merchants.

  • Promotional offers are subject to product availability and applicable terms.

  • The price displayed at the time of order confirmation shall apply unless a clear technical or pricing error has occurred.

7. Payment

The application may offer one or more of the following payment methods, subject to availability:

  • Cash on Delivery (COD).

  • Any additional payment methods introduced by Wamda in the future.

Electronic payments are securely processed through authorized third-party payment service providers. Wamda does not store users' sensitive payment card information.

8. Delivery

Wamda makes reasonable efforts to ensure timely delivery of orders within the estimated delivery time displayed to the user. However, delivery times are estimates only and may be affected by circumstances beyond Wamda's control, including:

  • Traffic congestion.

  • Weather conditions.

  • Technical failures.

  • High order volumes.

  • Delays in food preparation or order processing by the merchant.

Estimated delivery times do not constitute a guaranteed delivery commitment.

9. Cancellation and Refunds

All cancellations and refunds are governed by Wamda's Refund Policy.

Once an order has entered the preparation stage, been dispatched for delivery, or successfully delivered, cancellation or refund requests may not be accepted except where required by applicable law or approved by Wamda.

10. User Obligations

The user agrees not to:

  • Provide false or misleading information.

  • Place fraudulent or fake orders.

  • Misuse the application or its services.

  • Attempt to hack, disrupt, or gain unauthorized access to the application or its systems.

  • Upload, publish, or transmit unlawful or offensive content.

  • Abuse, harass, or threaten merchants, delivery partners, support staff, or other users.

Wamda reserves the right to suspend or permanently terminate accounts and pursue any legal remedies available in the event of such violations.

11. Intellectual Property

All intellectual property rights relating to the Wamda application, including its name, trademarks, logo, software, designs, user interface, databases, graphics, text, and content, are owned by Wamda or its licensors.

No part of the application may be copied, reproduced, modified, distributed, or commercially exploited without prior written authorization.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Wamda shall not be liable for:

  • Information or errors provided by merchants.

  • The quality, safety, or suitability of products supplied by merchants.

  • Delivery delays caused by circumstances beyond reasonable control.

  • Interruptions resulting from internet service providers or technical failures.

  • Any indirect, incidental, consequential, or special damages arising from the use of the application.

13. Suspension or Termination

Wamda reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or permanently terminate any user account if it determines that the user has violated these Terms or misused the application.

14. Amendments

Wamda reserves the right to amend these Terms and Conditions at any time. Any amendments shall become effective immediately upon publication within the application or through official communication channels.

Continued use of the application following such amendments constitutes acceptance of the revised Terms.

15. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws in force in the State of Palestine. Any dispute arising out of or relating to these Terms or the use of the application shall be subject to the exclusive jurisdiction of the competent Palestinian courts, unless otherwise required by applicable law.
